Terms and Conditions

Following are the terms and conditions for use of the House of Mistry website (and any sub-domains and domains pointing to it, which are owned by the House of Mistry Limited including but not limited to – houseofmistry.com, houseofmistry.co.uk, mistry.co.uk). They cover all retail transactions. For the avoidance of doubt, it is assumed that all transactions have taken place in England (regardless of your location) and will be governed by English law.

The House of Mistry Limited owns full copyright over the design of the House of Mistry web site, in addition to all text and imagery displayed. Permission must be requested before reproducing any of the site. Exception is granted only for the purpose of making a hard copy for the benefit of ordering.

Conditions of use 
The House of Mistry Limited reserves the right to refuse to complete any order on the condition it refunds all monies paid in full.

Whilst we always endeavour to have the latest anti virus protection and security updates, neither The House of Mistry LTD nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with use of this Web site including direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties unless negligence on our part can be proved.

A contract will be formed between the House of Mistry and the customer when our payment processor (Worldpay) confirms that the customers card has been debited. At this point the customer will be forwarded to a web page which confirms that the payment has been cleared and two emails will be sent, one from Worldpay again confirming that the payment has been cleared and another from us confirming that the order has been received. If you do not receive either of the e-mails within 24 hours please make us aware as soon as possible by any of the methods included on the contact us page.

The point at which the customer confirms that they wish to place the order and the have the relevant amount debited from their account is when they click the “Make Payment” button at the billing page.

The Consumer Protection (Distance Selling) Regulations 2000 
Under the above regulations you may cancel any order, by writing (which includes fax and email), within 7 working days of the purchase and receive a full refund within 30 days. You must take reasonable care whilst the goods are in your possession and in returning them.

Damaged / Faulty and Misdescribed goods 
The House of Mistry will give a refund (either full or partial) for products which arrive faulty, damaged or not as described. if you feel this is the case please contact us immediately and we will come to an arrangement to replace or refund the goods.

Order fulfilment 
We endeavour to fulfil all orders within 7 days of the order being placed. However we cannot guarantee this. For the benefit of planning it should be assumed that orders will take up to 28 days to be processed. In the unlikely event of a product being out of stock we will try to contact you to arrange a substitute, a refund or to hold the order until the item is in stock. If we cannot contact you within 7 days we will send the order minus the out of stock item and refund the cost of the item and any postage costs associated with the missing item.
